I closed this trust sale in the Bel Air hills in one of the toughest markets in recent memory, less than three months after the Palisades fire, at a moment when insurance was nearly impossible to secure and most buyers had walked away from the hillside market entirely. Difficult sales are where experience earns its keep. If your property is complicated, contested, hard to insure or hard to finance, that is precisely the kind of sale I want to talk to you about.

This is the largest and most complex sale I have handled, not the typical size of estate I work with. Most of my probate and trust clients are everyday families with modest homes, and every sale gets the same level of care regardless of size.

The part nobody explains

Court confirmation and the overbid, in plain English

This is the single most misunderstood part of selling a home in probate, and the step that makes families most anxious. Here is what actually happens.

Step one

Which authority do you have?

Under the Independent Administration of Estates Act, an estate is granted either full authority or limited authority. With full authority most sales close much like an ordinary transaction. With limited authority, the court has to confirm the sale. Everything downstream depends on which one your Letters say, which is the first document I ask to see.

Step two

The confirmation hearing

If confirmation is required, your accepted offer is not the end of it. The sale is noticed and set for hearing, and Los Angeles County probate matters are heard downtown at the Stanley Mosk Courthouse. Because LA runs the busiest probate calendar in California, that date is usually set well out, which is exactly why the property should be marketed properly in the meantime rather than parked.

Step three

The overbid in open court

At the hearing the court invites other buyers to bid in the room, opening above your accepted price by a minimum increment set under California statute and continuing in further increments from there. Whoever prevails becomes the buyer. It sounds alarming. In practice, a well marketed property with real competition often ends up ahead, and my job is to have the room stocked with qualified bidders rather than empty.

Why this matters for choosing an agent. An agent who has not done a confirmation sale will often price and market it like an ordinary listing, then be caught out by the notice requirements, the bidding increments, the deposit rules or a buyer who does not understand they can be outbid at the hearing. Deals die that way. I have taken many sales through this process, including litigated and receivership properties, and I will tell you at our first conversation exactly which path your estate is on.

How long does probate take in Los Angeles County?
A California probate commonly runs nine to eighteen months, and Los Angeles County sits at the longer end of that range because it is the busiest probate court in the state. Hearings are set months out, so the calendar, not the property, is usually what sets the pace. The important thing to understand is that the home does not have to sit empty and unsold while you wait. In most cases we can prepare, list and market the property while the probate is still open, which stops the estate from carrying an empty house for a year.
What is the overbid process in a Los Angeles probate sale?
When an estate has only limited authority under the Independent Administration of Estates Act, an accepted offer is not final. The sale goes to a confirmation hearing where the court invites other buyers to bid in open court, starting above the accepted price under a formula set by California statute. Whoever prevails in that room is the buyer. It sounds unnerving, and it is the step families worry about most, but it is routine when the property has been marketed properly and the paperwork is right. I have taken many sales through it, and there is more detail in the court confirmation section above.
Do I need to go through probate to sell my parents’ house in Los Angeles?
It depends entirely on how title was held, not on where the house is. If the property sat in a living trust, was held in joint tenancy, or the estate falls under California’s small estate threshold, you may be able to sell without a full probate. If it was in your parent’s name alone with no trust, probate is usually required. Before you assume the worst, get the deed pulled and looked at. That single document answers most of the question, and I am glad to look at it with you at no cost.
What is the difference between a trust sale and a probate sale in California?
A trust sale is usually the smoother of the two. The successor trustee generally holds authority to sell without court supervision, so it proceeds much like an ordinary listing, though the trustee still owes a duty to the beneficiaries to get a defensible price. A probate sale involves the court, and depending on the authority granted it may require a confirmation hearing and an overbid. Different rules, different timelines, and I handle both regularly.
We are several siblings inheriting one house and we do not agree. What now?
This is one of the most common situations I am called into, and it is rarely really about the house. What helps is an independent, documented opinion of value that nobody in the family authored, a clear written plan every heir receives at the same time, and one point of contact who talks to all of you rather than to a favorite. I stay neutral among heirs. Where a genuine legal dispute exists I will say so plainly and work alongside your attorney rather than pretend a listing solves it.
How does Proposition 19 affect a home I inherited in Los Angeles?
Proposition 19 narrowed the old parent to child exclusion considerably. In general an inherited property is reassessed to current market value for property tax purposes unless the child makes it their own primary residence, and even then the exclusion is capped. In Los Angeles, where a long held family home may carry a very low Proposition 13 basis, that reassessment can change the math on keeping the property dramatically. Run the numbers with your attorney or CPA before you decide, and I am happy to work directly with them.
Will I owe capital gains tax if I sell an inherited house in California?
Usually far less than people fear. Inherited property generally receives a stepped-up cost basis equal to its fair market value on the date of death, so if you sell reasonably close to that value the taxable gain can be small or nothing at all. This is exactly why a properly supported date of death valuation matters, and why it is worth getting one rather than guessing. Confirm the specifics with your CPA.
The house is full of a lifetime of belongings and needs work. Do I have to deal with that first?
No, and please do not let that be the thing that stalls you. Clearing out a family home is the part that breaks people, and it is the part I can take off your plate. I coordinate cleanout, estate sale or donation of the contents, and any light repairs worth doing. Sometimes the right answer is to spend a little and net considerably more, and sometimes the right answer is to sell as is. I will tell you honestly which one your property is.
